Plaintiff Weston Holladay LLC, by and through its attorney of record, Joe A. Garza, Jr., Fulton Jeang, PLLC, P.O. Box 93661, Southlake, TX 76092, brought suit under Cause No. 117699 in the 40th Judicial District Court of Ellis County, Texas, regarding 207.556 acres located in Ellis County, Texas (the “Gap Parcel”), on the following described real property of which Defendants, UNKNOWN DOES, are potential parties in interest:
"BEING 15.336 acres of land in the A. J. PORTER SURVEY, ABSTRACT No. 829, ELLIS COUNTY, TEXAS, and being a part of the occupied Adams & Hooker lands that lie North of that Tract 3 called 7.5 acres, that Tract 6(a) called 8.8 acres, and east of that Tract 11 called 44.75 acres from Roger Adams, Independent Executor to Roger Adams & Patti Hooker on May 24, 2024 and recorded in Document Number 2416316 of the Deed Records of Ellis County, Texas (hereinafter shown as DN, DR, volume/page), same being a part of that called 209.20 acres in the Certificate of City Secretary for the City of Red Oak for Ordinance No. 08-90, amending ordinance No. 08-32 as shown in 2421/567 for non-annexation: SAID tract being described as follows: BEARINGS are based on the Texas Coordinate System of 1983, Texas North-Central Zone per GPS observations: All coordinates are U.S. Survey Feet, NAD83(2011) Epoch 2010.0000 per static GPS observations and an OPUS solution through the NGS website: At the Point of Beginning (POB), the angle of convergence is 00°57'55" and the combined scale factor is 0.999901: To get geodetic bearings, rotate the bearings recited herein, clockwise: All distances are grid and to get surface distances, divide the distances recited herein by the combined scale factor:

BEGINNING at a 1/2" steel rod found painted yellow for the North occupied corner of Adams & said 209.20 acres and an "ELL" corner of that called 108.70 acres from Doug & Betty Illsley to Anthony Viazis on June 29, 2006 in 2232/511, DR, same having a state plane coordinate with a Northing of 6865223.846 feet and an Easting of 2514185.607;
THENCE South 29°57'24" East, with the occupied Northeast line of Adams and said 209.20 acres, and the most Southerly Southwest line of said 108.70 acres, 545.75 feet to a point for the North corner of said 8.8 acres;
THENCE with the Northwest lines of said 8.8, the Northeast and Northwest lines of said 7.5, and the Northeast line of said 44.75 acres as follows:
South 59°11'36" west, 737.31 feet to a point;
North 31°01'24" West, 195.80 feet to a point;
South 59°11'19" west, 774.76 feet to a point;
North 29°17' 14" West, 337.70 feet to a 1/2" steel rod found painted yellow in the Northeast line of said 44.75 acres for an "ELL" corner of said 209.20 acres and the South corner of that called 13.787 acres from Dan & Kathy Quinn to Apollo Real Estate Holdings, Ltd. On April 13, 2010 in 2507/1927, DR;
THENCE with the occupied Northwest lines of Adams and said 209.20 acres and said 13.787 acres and that Tract 2 called 10.737 acres from Dan & Kathy Quinn to Apollo Real Estate Holdings, Ltd. on July 23, 2009 in 2463/1242, DR, as follows:
North 59°11'19" East, 764.39 feet to a 1/2" steel rod found by a 5 feet tall galvanized iron pipe post, from which a 1/2" steel rod found at a 3" iron pipe fence corner is South 33°20'07" East, 20.66 feet; North 30°37' 13" West, 20.71 feet to a 1/2" steel rod found; North 59°50'46" East, passing the East corner of said 13.787 acres and the South corner of said 10.737 acres, continuing in all 688.24 feet to a 1/2" steel rod found painted yellow for the East corner of said 10.737 acres and an "ELL" corner of said 108.70 acres;
THENCE North 59°44'22" East, with the occupied Northwest line of Adams and said 209.20 acres and an interior line of said 108.70 acres, 59.31 feet to the PLACE OF BEGINNING, and containing within these calls, 15.336 acres of land.
This tract does not appear to adjoin a public road and is based on field work completed on December 31, 2024."
