TO: THE UNKNOWN HEIRS AT LAW OF HAROLD R. BENNER AND DEBBIE E. BENNER, DECEASED
Greetings:
NOTICE TO DEFENDANT: “You have been sued. You may employ an attorney. If you or your
attorney does not file a written answer with the clerk who issued this citation by 10:00 a.m. on the Monday,
next following the expiration of 42 days after the date this citation was issued, a default judgment may be
taken against you.”
YOU ARE HEREBY COMMANDED to appear before the 40TH Judicial District Court of Ellis,
County, Texas, at the Courthouse thereof, in Waxahachie, Texas, by filing a written answer at or before ten
o’clock A.M. of the first Monday next after the expiration of forty-two (42) days from the date of the issuance
of this citation, in cause number 100211, on the docket of said Court and styled:

A brief summary of the nature of this suit is:
This is a Petition for Judicial Foreclosure of real property commonly known as 104 Beverly, Garret,
TX 75149. The Petition alleges that the record owners of the property, Harold R. Benner and Debbie E.
Benner are deceased and that some of their Heirs, Assigns & Devisees are Unknown.
The property is legally described as:
ALL THAT CERTAIN LOT, TRACT OR PARCEL OF LAND BEING LOT 2, BLOCK “A” OF
HILLGLEN MOBILE ESTATES, SECTION TWO, A REPLAT OF BLOCK “A” OF HILLGLEN
MOBILE ESTATES, PHASE ONE, AN ADDITION TO THE CITY OF GARRETT, ELLIS COUNTY,
TEXAS, AS RECORDED IN CABINET B, SLIDE 662 OF THE MAP RECORDS OF ELLIS COUNTY, ‘
TEXAS.
