WAXAHACHIE – Ellis County Commissioners voted unanimously to approve an easement with the City of Waxahachie and Alpine Start Development for utility work on Ellis County owned property.

Ellis County Judge John Wray explained there is developer who owns a tract of land roughly where FM 878 and FM 879 split in the triangle and the developer is intending to develop a residential housing project and possibly additional improvements at the location.

The developer asked to connect their sewer line down FM 879 and they want to cross right along the property line of the county farm into Coal Creek where there is a Waxahachie sewer main located in the creek bottom.

Wray thought around two years ago the county agreed to grant an easement to the developer and there was a minute order entered in June of 2023.

He said there was possibly some right of way acquisition on FM 879 too.

It was never discussed why the entire process has taken two years, but it came back to the commissioners for another approval, which was approved pending legal review.

It was mentioned the developer also agreed to compensate the county for the easement and Wray added, “We kind of understood it was all buttoned up but the easement was never signed and recorded so we were advised to bring it back.”
