NOTICE OF APPLICATION OF CITY OF WILMER TO AMEND ITS CERTIFICATES OF CONVENIENCE AND NECESSITY TO PROVIDE WATER AND UTILITY SERVICE IN DALLAS COUNTY, TEXAS


City of Wilmer has filed an application with the Public Utility Commission of Texas to amend its water Certificate of Convenience and Necessity (CON) No. 10100 and sewer CCN No. 20040 for the provision of retail water and sewer utility service in Dallas County, Texas.

The requested area overlaps the district boundaries of:

• Texas Tri-Modal MUD 2

• Trinity River Authority of Texas

• Wilmer MUD I

If these districts do not request a public hearing, the Commission shall determine that the district is consenting to City of Wilmer’s request to provide retail water and sewer utility service in the requested area.

Requested Water Area 1:

The requested water area I is located approximately 0.3 miles south of downtown Wilmer, Texas, and is generally bounded on the north by West Pleasant Run Road; on the east by Cook Road; on the south by Stainback Road; and on the west by Ferris Road.

The requested water area 1 includes 303 customer connections and approximately 3 284.9 acres of uncertificated area to amend (add) to CCN No. 101 00.

Requested Water Area 2:

The requested water area 2 is located approximately 0.8 miles north of downtown Wilmer, Texas, and is generally bounded on the north by Fulghum Road; on the east by Post Oak Road; on the south by Goode Road; and on the west by Millers Ferry Road.

The requested water area 2 includes 21 customer connections and approximately 1.578 acres of uncertificated area to amend (add) to CCN No. 10100.

Requested Water Area 3:

The requested water area 3 is located approximately 1.2 miles northwest of downtown Wilmer, Texas, and is generally bounded on the north by Talco Road; on the east by Sunrise Road; on the south by Greene Road; and on the west by Pinto Road

The requested water area 3 includes 1 customer connection and approximately 350.1 acres of uncertificated area to amend (add) to CCN No. 10100.

Requested Water Area 4:

The requested water area 4 is located approximately 0.9 miles northeast of downtown Wilmer, Texas, and is generally bounded on the north by Cottonwood Valley Road; on the east by Geller Road; on the south by Mars Road; and on the west by Goode Road.

The requested water area 4 includes 4 customer connections and approximately 115.8 acres of uncertificated area to amend (add) to CCN No. 1 0100

Requested Water Area 5:

The requested water area 5 is located approximately 0.3 miles east of downtown Wilmer, Texas, and is generally bounded on the north by Belt Line Road; on the east by Geller Road; on the south by Mars Road; and on the west by South Dallas Avenue.

The requested water area 5 includes 282 customer connections and approximately 107.2 acres of uncertificated area to amend (add) to CCN No. 10100.

Requested Water Area 6:

The requested water area 6 is located approximately 1.3 miles northeast of downtown Wilmer, Texas, and is generally bounded on the north by Belt Line Road; on the east by Geller Road; on the south by Mars Road; and on the west by South Goode Road.

The requested water area 6 includes 0 customer connections and approximately 42.5 acres of uncertificated area to amend (add) to CCN No. 10100

Requested Water Area 7:

The requested water area 7 is located approximately 1.5 miles northeast of downtown Wilmer, Texas, and is generally bounded on the north by Cottonwood Valley Road; on the east by Geller Road; on the south by Belt Line Road; and on the west by Goode Road.

The requested water area 7 includes 4 customer connections and approximately 10.1 acres of uncertificated area to amend (add) to CCN No. 10100.

Total Requested Water Areas (1-7):

The total requested water areas (1-7) include 615 customer connections and approximately 5,488.6 acres of uncertificated area to amend (add) to CCN No. 10100. The application proposes the addition of approximately acres to CCN No. 10100.

Requested Sewer Area 1:

The requested sewer area I is located approximately 0.3 miles south of downtown Wilmer, Texas, and is generally bounded on the north by West Pleasant Run Road; on the east by Cook Road; on the south by Stainback Road; and on the west by Ferris Road.

The requested sewer area I includes 306 customer connections and approximately 3 305.1 acres of uncertificated area to amend (add) to CCN No. 20040.

Requested Sewer Area 2:

The requested sewer area 2 is located approximately 0.8 miles north of downtown Wilmer, Texas, and is generally bounded on the north by Fulghum Road; on the east by Post Oak Road; on the south by Goode Road; and on the west by Millers Ferry Road.

The requested sewer area 2 includes 21 customer connections and approximately 1 582.5 acres of uncertificated area to amend (add) to CCN No. 20040

Requested Sewer Area 3:

The requested sewer area 3 is located approximately miles northwest of downtown Wilmer, Texas, and is generally bounded on the north by Talco Road; on the east by Sunrise Road; on the south by West Pleasant Run Road; and on the west by Pinto Road.

The requested sewer area 3 includes J customer connection and approximately 24.5 acres of uncertificated area to amend (add) to CCN No. 20040.

Requested Sewer Area 4:

The requested sewer area 4 is located approximately 0.9 miles northeast of downtown Wilmer, Texas, and is generally bounded on the north by Cottonwood Valley Road; on the east by Geller Road; on the south by Mars Road; and on the west by Goode Road.

The requested sewer area 4 includes 4 customer connections and approximately 15.8 acres of uncertificated area to amend (add) to CCN No. 20040.

Requested Sewer Area 5:

The requested sewer area 5 is located approximately 0.3 miles east of downtown Wilmer, Texas, and is generally bounded on the north by Belt Line Road; on the east by Geller Road; on the south by Mars Road; and on the west by South Dallas Avenue.

Requested Sewer Area 6:

The requested sewer area 6 is located approximately 1.3 miles northeast of downtown Wilmer, Texas, and is generally bounded on the north by Belt Line Road; on the east by Geller Road; on the south by Mars Road; and on the west by South Goode Road.

The requested sewer area 6 includes 0 customer connections and approximately 42.5 acres of uncertificated area to amend (add) to CCN No. 101 00.

Requested Sewer Area 7:

The requested sewer area 7 is located approximately 1.5 miles northeast of downtown Wilmer, Texas, and is generally bounded on the north by Cottonwood Valley Road; on the east by Geller Road; on the south by Belt Line Road; and on the west by Goode Road.

The requested sewer area 7 includes 4 customer connections and approximately 10.1 acres of uncertificated area to amend (add) to CCN No. 20040.

Total Requested Sewer Areas (1-7):

The total requested sewer areas (1-7) include 618 customer connections and approximately 5,187.7 acres of uncertificated area to amend (add) to CCN No. 20040. The application proposes the addition of approximately acres to CCN No. 20040.

Persons who wish to intervene in the proceeding or comment upon action sought should contact the Public Utility Commission, P.O. The deadline for intervention in the proceeding is (30 days from the mailing or publication “notice, whichever occurs later, unless otherwise provided by the presiding officer). You must send a letter requesting intervention to the commission which is received by that date.

If a valid public hearing is requested, the Commission will refer the application to the State Office of Administrative Hearings (SOAH) for a hearing. If no settlement is reached and an evidentiary hearing is held, SOAH will submit a recommendation to the Commission for a final decision. An evidentiary hearing is a legal proceeding similar to a civil trial in state district court.

A landowner with a tract of land at least 25 acres or more, that is partially or wholly located within the requested area, may file a written request with the Commission to be excluded from the requested area (“opt-out”) within (30) days from the date that notice was provided by the Utility.

All landowner opt-out requests must include the commission docket number, CCN number, the total acreage to remove from the requested area, a sealed or embossed metes and bounds description or survey of the landowner’s tract of land, and the landowner’s name, address, email address and fax number, if applicable.

A landowner that opts out from the requested area releases the applicant’s obligation to provide retail water and sewer utility service to the removed land for any reason.
