FERRIS INDEPENDENT SCHOOL DISTRICT
WHEREAS, the Board of Trustees (the “Board”) of the Ferris Independent School District (the “District”) has heretofore approved an order (the “Original Order”) calling a bond election in the District for May 2, 2020, which election was postponed due to the outbreak of the COVID-19 pandemic; and
WHEREAS, the Board deems it advisable to modify the Original Order, and to adopt this order to provide for the calling of the bond election on November 3, 2020 (the “Election”); and
WHEREAS, for purposes of the information to be provided to the voters and included herein, the date of adoption of this order shall be deemed the date of calling the November 3, 2020 bond election: and
WHEREAS, the bond referendum is subject to the provisions of Section 45.003, Texas Education Code, and the District is contracting with Ellis County and Dallas County (together, the “Contracting County”) for the administration of the Election pursuant to an interlocal agreement with the Contracting County (the “Election Contract”); and
WHEREAS, Ellis County, acting through the Ellis County Elections Administrator and Dallas County, acting through the Dallas County Elections Administrator (together, the “Elections Administrator”) in accordance with the Election Contract will provide for the administration of the Election for residents of the District residing in their particular county;
WHEREAS, it is hereby officially found and determined that the meeting at which this Order was adopted was open to the public, and public notice of the time, place, and purpose of the meeting was given, all as required by the Texas Government Code, Chapter 551.
THEREFORE, BE IT ORDERED BY THE BOARD OF TRUSTEES OF THE
FERRIS INDEPENDENT SCHOOL DISTRICT:
Section 1. Findings. The statements contained in the preamble of this Order are true and correct and adopted as findings of fact and operative provisions hereof.
Section 2. Election Ordered, Polling Places. The Election shall be held in the District between the hours of 7:00 a.m. and 7:00 p.m. on November 3, 2020 (“Election Day”). The Election is to be conducted by the respective Contracting County, as provided by Chapter 271, Texas Election Code (the “Code”) and the Election Contract. Voting for the Election on Election Day and Early Voting shall occur on the dates and during the hours and at the designated polling places as set forth in Exhibit A attached hereto, which exhibit is hereby made a part hereof for all intents and purposes. Exhibit A shall be modified to include additional or different Election Day polling places required to conform to the Code and the Election Contract.
Section 3. Early Voting. Early voting shall be administered by the Contracting County. Early voting by personal appearance shall begin on October 13, 2020 and conclude on October 30, 2020 and will be conducted at the Early Voting locations on the dates and at the times specified in Exhibit A attached hereto. The early voting polling places shall remain open during such hours for early voting by personal appearance for any registered voter of the District at such voting place. Exhibit A shall be modified to include additional or different early voting polling places required to conform to the Election Contract and the Code.
Section 4. Election Officials. The appointment of the Presiding Election Judges, Alternate Judges, Early Voting Clerks, the Presiding Judge of the early ballot board and other election officials for the Election shall be made by the respective Elections Administrator in accordance with the Election Contract and the Code. The respective Elections Administrator may employ other personnel necessary for the proper administration of the Election, including such part-time help as is necessary to prepare for the Election, to ensure the timely delivery of supplies during early voting and on Election Day, and for the efficient tabulation of ballots at the central counting station. The Board of Trustees hereby authorizes the Superintendent, President, Vice President or the Secretary of the Board of Trustees to execute or attest on behalf of the District the Election Contract with the Contracting County.
Section 5. Voting by Mail. Applications for voting by mail for all residents of the District shall submitted by personal delivery not later than October 12, 2020 or shall be mailed to the address below and received (not postmarked) by October 23, 2020.

Section 6. Early Voting Ballots. An Early Voting Ballot Board shall be created to process early voting results of the Election and the Presiding Judge of the Early Voting Ballot Board shall be designated by the respective Elections Administrator. The Presiding Judge of the Early Voting Ballot Board shall appoint two or more additional members to constitute the Early Voting Ballot Board members and, if needed, the Signature Verification Committee members required to efficiently process the early voting ballots.
Section 7. Qualified Voters. All qualified electors of and residing in the District, shall be entitled to vote at the election.

Section 10. Compliance with Federal Law. In all respects, the Election shall be conducted in accordance with the Code. Pursuant to the federal Help America Vote Act (“HAVA”) and the Code, at each polling place there shall be at least one voting system that is equipped for disabled individuals, and each such voting system shall be a system that has been certified by the Texas Secretary of State as compliant with HAVA and the Code. The District hereby finds that the voting system to be used by the respective Elections Administrator in administering the Election is such a system, and orders that such voting equipment or other equipment certified by the Texas Secretary of State shall be used by the District in its elections.
Section 11. Debt Obligations. The following information is provided in accordance with the provisions of Section 3.009(b), Texas Election Code.
(a) The proposition language that will appear on the ballot is set forth in Section 9 hereof.
(b) The purpose for which the bonds are to be authorized is set forth in Section 8 hereof.
(c) The principal amount of the debt obligations to be authorized is $8,000,000 for Proposition A and $4,000,000 for Proposition B.
(d) If the bonds are approved by the voters, the Board of Trustees will be authorized to levy annual ad valorem taxes, on all taxable property in the District, sufficient, without limit as to rate or amount, to pay the principal of and interest on the bonds and the cost of any credit agreements executed in connection with the bonds.
(e) Based upon the bond market conditions at the date of adoption of this Order, the maximum interest rate for any series of the bonds is estimated to be 5.00%. Such estimate takes into account a number of factors, including the issuance schedule, maturity schedule and the expected bond ratings of the proposed bonds and notes. Such estimated maximum interest rate is provided as a matter of information, but is not a limitation on the interest rate at which the bonds or notes, or any series thereof, may be sold.
(f) If the bonds are approved, they may be issued in one or more series, to mature serially, over a period not to exceed 30 years from the date of issuance of each series of bonds.
(g) The aggregate amount of the outstanding principal of the District’s debt obligations as of the date of this Order is $33,695,000.00.
(h) The aggregate amount of the outstanding interest of the District’s debt obligations as of the date of this Order is $10,690,266.40.
(i) The ad valorem debt service tax rate for the District as of the date of this Order is $0.3789 per $100 of taxable assessed valuation.

DISTRITO ESCOLAR INDEPENDIENTE
DE FERRIS
EN VISTA DE QUE la Junta de Síndicos (la “Junta”) del Distrito Escolar Independiente de Ferris (el “Distrito”) hasta el presente ha aprobado una orden (la “Orden Original”) para convocar una elección de bonos en el Distrito para el 2 de mayo de 2020, elección que se postergó debido al brote de la pandemia de COVID-19; y
EN VISTA DE QUE la Junta considera aconsejable modificar la Orden Original y adoptar esta orden para disponer la convocatoria a la elección de bonos del 3 de noviembre de 2020 (la “Elección”); y
EN VISTA DE QUE para propósitos de la información que se proveerá a los votantes e incluida en la presente, la fecha de adopción de esta orden será considerada la fecha de convocatoria de la elección de bonos del 3 de noviembre de 2020; y
EN VISTA DE QUE el referéndum de bonos está sujeto a las disposiciones de la Sección 45.003 del Código de Educación de Texas, y el Distrito está celebrando un contrato con el Condado de Ellis, Texas y el Condado de Dallas, Texas, (juntos el “Condado Contratante”) para la administración de la Elección en virtud de un convenio interlocal con el Condado Contratante (el “Contrato Electoral”); y
EN VISTA DE QUE el Condado de Ellis, actuando a través del Administrador de Elecciones del Condado de Ellis y el Condado de Dallas, actuando a través del Administrador de Elecciones del Condado de Dallas (juntos el “Administrador de las Elecciones”), de acuerdo con el Contrato Electoral estará a cargo de administrar la Elección para los residentes del Distrito que residen en los Condado particular;
EN VISTA DE QUE por la presente se halla y determina oficialmente que la asamblea en la cual esta Orden fue adoptada estuvo abierta al público, y que se dio aviso público de la hora, el lugar y el propósito de la asamblea, todo según lo exige el Capítulo 551 del Código de Gobierno de Texas.
POR LO TANTO, LA JUNTA DE SÍNDICOS
DEL DISTRITO ESCOLAR INDEPENDIENTE
DE ELLIS ORDENA:
Sección 1. Hallazgos. Las declaraciones contenidas en el preámbulo de esta Orden son verdaderas y correctas y se adoptan como determinaciones de hechos y como disposiciones operativas de la presente.
Sección 2. Elección ordenada; lugares de votación. La Elección se llevará a cabo en el Distrito en el horario de 7:00 a.m. a 7:00 p.m. el 3 de noviembre de 2020 (el “Día de Elección”). La Elección será realizada por el Condado Contratante respectivo, según lo dispuesto por el Capítulo 271 del Código Electoral de Texas (el “Código”) y el Contrato Electoral. La votación del Día de Elección y la votación anticipada se llevarán a cabo en las fechas y durante los horarios y en los lugares de votación designados de la forma indicada en el Anexo A adjunto a este documento, el cual, por la presente, se incorpora a la misma a todos los efectos. El Anexo A será modificado para incluir lugares de votación adicionales o diferentes para el Día de Elección requeridos para cumplir con el Código y el Contrato Electoral.
Sección 3. Votación anticipada. La votación anticipada será administrada por el Condado Contratante. La votación anticipada en persona comenzará el 13 de octubre de 2020 y terminará el 30 de octubre de 2020, y se llevará a cabo en los lugares de votación anticipada en las fechas y los horarios especificados en el Anexo A adjunto a este documento. Los lugares de votación anticipada se mantendrán abiertos durante dicho horario para la votación anticipada en persona para cualquier votante registrado del Distrito en dicho lugar de votación. El Anexo A será modificado para incluir lugares de votación adicionales o diferentes para la elección anticipada requeridos para cumplir con el Contrato Electoral y el Código.
Sección 4. Funcionarios Electorales. La designación de los Jueces Electorales Presidentes, Jueces Alternos, Oficiales de Votación Anticipada, el Juez Presidente del consejo de boletas de votación anticipada y demás funcionarios electorales de la respectivo Elección la hará el Administrador de Elecciones de acuerdo con el Contrato Electoral y el Código. El respectivo Administrador de Elecciones puede emplear otro personal necesario para la administración adecuada de la Elección, lo que incluye la ayuda de medio tiempo que sea necesaria para preparar la Elección, para asegurar la entrega puntual de suministros durante la votación anticipada y el Día de Elección, y para la tabulación eficiente de las boletas de votación en la estación central de conteo. Por la presente, la Junta de Síndicos autoriza al Superintendente, Presidente, Vicepresidente o Secretario de la Junta de Síndicos a firmar o atestiguar en nombre del Distrito el Contrato Electoral con el Condado Contratante.
Sección 5. Votación por correo. Las solicitudes de votación por correo para todos los residentes del Distrito deben entregarse en persona a más tardar el 12 de octubre de 2020 0 deben ser enviadas por correo postal a la siguiente dirección y ser recibidas (no mataselladas) para el 23 de octubre de 2020.

Sección 6. Boletas de votación anticipada. Se creará un Consejo de boletas de votación anticipada para procesar los resultados de la votación anticipada de la Elección, y el respectivo Administrador de Elecciones designará al Juez Presidente de dicho Consejo. El Juez Presidente del Consejo de boletas de votación anticipada nombrará a dos o más miembros adicionales para formar el Consejo de boletas de votación anticipada y, de ser necesario, a los miembros del Comité de verificación de firmas requeridos para procesar de forma eficiente las boletas de votación anticipada.
Sección 7. Votantes habilitados. Todos los votantes habilitados y residentes en el Distrito tendrán derecho a votar en la elección.

¿Se deberá autorizar a la Junta de Síndicos del Distrito Escolar Independiente de Ferris a emitir los bonos del Distrito, en una o más series, en la cantidad de capital total de $8,000,000, para el propósito de adquirir, construir, renovar y equipar instalaciones escolares en el Distrito, con los bonos venciendo, devengando interés y siendo emitidos y vendidos en conformidad con la ley al momento de emisión; y se deberá autorizar a la Junta de Síndicos a imponer y comprometer y hacer tasar y recaudar impuestos anuales ad valorem sobre toda propiedad gravable en el Distrito, suficientes, sin límite en cuanto a tasa o cantidad, para pagar el capital y el interés de los bonos y el costo de cualquier acuerdo de crédito firmado en conexión con los bonos?

Las boletas oficiales para la Elección se prepararán en conformidad con el Código Electoral de Texas de manera que se permita a los votantes votar “A FAVOR” o “EN CONTRA” de las PROPOSICIONES antedichas, y de manera que contengan ciertas disposiciones, marcas y lenguaje de acuerdo con los requisitos de la ley, y con dichas PROPOSICIONES expresadas básicamente de la siguiente manera:

LA EMISIÓN DE EN BONOS POR PARTE DEL DISTRITO ESCOLAR INDEPENDIENTE DE FERRIS PARA EL PROPÓSITO DE ADQUIRIR, CONSTRUIR Y EQUIPAR UNA INSTALACIÓN MULTIFUNCIÓN CUBIERTA DE PRÁCTICAS Y SALA DE PESAS Y LA IMPOSICIÓN DEL IMPUESTO PARA EL PAGO DE LOS MISMOS. ESTO ES UN AUMENTO AL IMPUESTO PREDIAL.
Sección 10. Conformidad con las leyes federales. En todos los sentidos, la Elección se llevará a cabo de acuerdo con el Código. En virtud de la Ley federal Ayude a América a Votar (“HAVA”) y el Código, cada lugar de votación dispondrá como mínimo de un sistema de votación equipado para personas con discapacidad, y cada uno los sistemas de votación de ese tipo será un sistema que cuente con la certificación de cumplimiento de HAVA y el Código emitida por el Secretario de Estado de Texas. Por la presente, el Distrito halla que el sistema de votación que será utilizado por el respectivo Administrador de Elecciones para administrar la Elección es uno de dichos sistemas, y ordena que el Distrito, en sus elecciones, utilice tal equipo de votación o algún otro equipo certificado por el Secretario de Estado de Texas.
Sección 11. Obligaciones de deuda. De acuerdo con las disposiciones de la Sección 3.009(b) del Código Electoral de Texas, se provee la siguiente información:
(a) El lenguaje de la proposición que aparecerá en la boleta de votación se establece en la Sección 9 de este documento.
(b) El propósito por el cual se han de autorizar los bonos se establece en la Sección 8 de este documento.
(c) La cantidad del capital de las obligaciones de deuda que se ha de autorizar es de $8,000,000 para la Proposición A y de $4,000,000 para la Proposición B.
(d) Si los votantes aprueban los bonos, la Junta de Síndicos estará autorizada a imponer impuestos anuales ad valorem sobre toda propiedad gravable del Distrito, suficientes, sin límite en cuanto a tasa o cantidad, para pagar el capital y el interés de los bonos y el costo de cualquier acuerdo de crédito firmado en conexión con los bonos.
(e) Según las condiciones del mercado de bonos en la fecha de adopción de esta Orden, la tasa de interés máxima para cualquier serie de los bonos se estima en 5.00%. Dicho estimado tiene en cuenta una serie de factores, incluidos el programa de emisión, el programa de vencimiento y las clasificaciones esperadas de bonos de los bonos y pagarés propuestos. Dicha tasa de interés máxima estimada se provee a título informativo, pero no es un límite sobre la tasa de interés a la que podrían venderse los bonos o pagarés, o cualquier serie de los mismos.
(f) Si se aprueban los bonos, se podrán emitir en una serie o más, para vencer en serie en un periodo que no exceda los 30 años a partir de la fecha de emisión de cada serie de bonos.
(g) La cantidad total de capital pendiente de las obligaciones de deuda del Distrito a la fecha de esta Orden es de $31,376, 169.10.
(h) La cantidad total de interés pendiente de las obligaciones de deuda del Distrito al inicio a la fecha de esta Orden es de $13,445,768.40.
(i) La tasa del impuesto del servicio de la deuda ad valorem para el Distrito a la fecha de esta Orden es de $0.3789 por cada $ 100 de tasación fiscal gravable.

(1) El interés sobre los bonos propuestos fue estimado con una tasa del 5.00% según las condiciones del mercado al 17 de agosto de 2020 y, en consecuencia, el interés pagadero sobre los bonos propuestos puede ser inferior o superior a las cantidades indicadas antes en función de las condiciones del mercado en el momento de venta de los bonos propuestos.
En base a la información y las suposiciones provistas en el cuadro anterior, el aumento anual máximo estimado en la cantidad de impuestos que serían gravados a una residencia principal en el Distrito con una tasación fiscal gravable de $ 100,000 para devolver los bonos propuestos, en caso de su aprobación, es de $0.40. Este estimado supone un crecimiento anual de la tasación fiscal gravable del Distrito a una tasa del 4.2% hasta el año fiscal 2028, y mantiene la tasación fiscal gravable constante a partir de entonces. LA EMISIÓN DE EN BONOS POR PARTE DEL DISTRITO ESCOLAR INDEPENDIENTE DE FERRIS PARA EL PROPÓSITO DE ADQUIRIR, CONSTRUIR Y EQUIPAR UNA INSTALACIÓN DEPORTIVA CUBIERTA / SALA DE PESAS Y LA IMPOSICIÓN DEL IMPUESTO PARA EL PAGO DE LOS MISMOS. ESTO ES UN AUMENTO AL IMPUES TO PREDIAL.

(1) El interés sobre los bonos propuestos fue estimado con una tasa del 5.00% según las condiciones del mercado al 17 de agosto de 2020 y, en consecuencia, el interés pagadero sobre los bonos propuestos puede ser inferior o superior a las cantidades indicadas antes en función de las condiciones del mercado en el momento de venta de los bonos propuestos.
En base a la información y las suposiciones provistas en el cuadro anterior, el aumento anual máximo estimado en la cantidad de impuestos que serían gravados a una residencia principal en el Distrito con una tasación fiscal gravable de $ 100,000 para devolver los bonos propuestos, en caso de su aprobación, es de $0.40. Este estimado supone un crecimiento anual de la tasación fiscal gravable del Distrito a una tasa del 4.2% hasta el año fiscal 2028, y mantiene la tasación fiscal gravable constante a partir de entonces. Se prevé que los bonos sean emitidos de manera tal que respeten el cronograma de devolución de la deuda existente del Distrito a fin de minimizar los aumentos en la tasa de impuestos (por ejemplo, el Distrito prevé evitar agregar nueva deuda en un año fiscal en el que el Distrito tiene pagos de bonos existentes).
