COMMERCIAL – INDUSTRIAL TAX ABATEMENT

ELLIS COUNTY, TEXAS


NOTICE IS HEREBY GIVEN

TO INTERESTED PERSONS THAT:


The Ellis County Commissioner’s Court for Ellis County, Texas, (the “County”) will consider approval of a Tax Abatement Agreement with Weston Holladay, LLC, owner and applicant, for property located in Reinvestment Zone No. 14, in the City of Red Oak, Texas, under the provisions of Chapter 312, Texas Tax Code (the “Act”).

The County will consider the Tax Abatement Agreement during its regular meeting to be held at 2:00 p.m. on Tuesday, December 9, 2025, in the County Commissioner’s Courtroom located on the second floor of the Historic Ellis County Courthouse, 101 West Main Street, Waxahachie, Texas 75165.

The proposed location will be approximately 926.8987± acres of land located in the following tracts:

TRACT 1:

BEING a 208.7749 acre (9,094,234 square foot) tract of land situated in the Andrew J. Porter Survey, Abstract No. 829, Ellis County, Texas; said tract being all of the tracts of land described as First Tract, Second Tract, Third Tract, Fourth Tract, Fifth Tract, Sixth Tract, Seventh Tract, Eighth Tract, Ninth Tract, Tenth Tract, Eleventh Tract, and Twelfth Tract in Executor’s Special Warranty Deed to Roger L. Adams and Patti Hooker recorded in Instrument Number 2416316, Official Public Records, Ellis County, Texas (O.P.R.E.C.T.); all acres of land within said tract or parcel are located within the jurisdictional boundary of the City of Red Oak, Ellis County, Texas.

TRACT 2:

BEING a 718.1238 acre (31,281,472 square foot) tract of land situated in the Andrew J. Porter Survey, Abstract No. 829, John Bell Survey, Abstract No. 61, Joseph Bell Survey, Abstract No. 62, William H. Morris Survey, Abstract No. 725, William H. Morris Survey, Abstract No. 719, and the James M. Riggs Survey, Abstract No. 902, Ellis County, Texas; said tract being all of a called 195.091 acre tract of land described in Special Warranty Deed to Kington Limited Partnership recorded in Volume 1648, Page 861, Deed Records, Ellis County, Texas (D.R.E.C.T.), all of a called 76.785 acre tract of land described in Warranty Deed with Vendor’s Lien to T. C. Lin recorded in Volume 817, Page 720, D.R.E.C.T., all of a called 184.936 acre tract of land described in Warranty Deed with Vendor’s Lien to T.C. Lin recorded in Volume 817, Page 726, D.R.E.C.T., all of a called 138.033 acre tract of land described in Warranty Deed with Vendor’s Lien to T. C. Lin recorded in Volume 839, Page 850, D.R.E.C.T., all of a called 87.22 acre tract of land described in Warranty Deed with Vendor’s Lien to Charles Pederson and Janie Pederson recorded in Volume 632, Page 227, D.R.E.C.T., and all of a tract of land known as Property ID 179975 in the Ellis County Appraisal District, apparent owner Joyce Ehrenberger, no recording information found in Ellis County Public Records; all acres of land within said tract or parcel are located within the jurisdictional boundary of the City of Red Oak, Ellis County, Texas.

The proposed improvements are datacenter related with a projected capital investment of approximately $2.19 billion dollars ($2,190,000,000.00) designated as a Tax Abatement Reinvestment Zone for future consideration of possible commercial-industrial tax abatement under the provisions of Chapter 312, Texas Tax Code (the “Act”); and

This notice of public hearing is given in accordance with the provisions of Section 312.201(d) of the Act.
