Wilmer RV Park saga continues

WILMER – In the ongoing saga of the trailer park in Wilmer which began in March, a judge in Dallas County has issued an order denying the defendant’s plea to the jurisdiction.

The plaintiff is EDD RD Park LLC, and the defendant is the City of Wilmer and Mayor Sheila Petta.

EDD RD RV Park’s owner Heran Patel is no stranger to the area, and some might remember his threats made to this newspaper.

Patel had said in March that he and several residents in the ETJ of Wilmer believed the city was illegally annexing. 

There was also some question as to there being no record with the Dallas County Appraisal District.

However, listings occur once a year normally at the beginning of the new calendar year. 

The time of a record being added to the Dallas County Appraisal District is not mandated by the City of Wilmer, but by the Dallas County Appraisal District.  

EDD RD Park’s Patel wanted his RV park in Wilmer’s ETJ, but it seemed the land in question was a part of the City of Wilmer.

The city does not currently allow for these types of developments.

Technically it seemed there was a belief Wilmer had at one time expanded its city limits into the ETJ, which unknowingly blocked Patel from locating his RV park in his desired location.

He appealed that decision to a judge, and the judge denied Wilmer’s plea to the jurisdiction. 

According to Wilmer City Attorney Michael Halla, this was not a final order made by the judge.

“The city might still appeal the decision,” Halla said in an email. “The item will be placed on the next city council meeting for executive session.” 

Halla added, “I do not know what the council will do, but at any rate this has no effect on the case going forward. The lawsuit will not begin in earnest until it ends in trial or settlement, unless the city decides to appeal, in which case everything would be halted to wait for the appeal to be final.” 

Also, part of the case as listed on the court documents for the plaintiff are Arthur Anderson and Matt Joeckel.

The property Patel wants to locate his RV park is on the east side of I-45 off Belt Line Road. 

In a recent email to the paper on June 28, Patel wrote, “You can write on the front page of the paper that Wilmer lost their plea to the jurisdiction against EDD RD RV Park LLC.”

He then added to Publisher Charles Hatfield, “The lawsuit is coming your way real soon my little princess.”

Patel has in the past threatened The Ellis County Press for unknown reasons writing, “I’ll be sure that my lawyer goes after everything you own,”

Patel also wrote in March to the publisher: “The difference between you and I is that I’ve got enough money to shut most of you old fu*ks down” and, “Let it be known the more educated liberals are coming into town with the brains and money to shut you up :).”

Finally, Patel wrote, “You’re just the sh_ _ on the bottom of people’s shoe. Enjoy.”
