FOR DISANNEXATION OF AREA FROM THE CITY OF LANCASTER
To: the Mayor and City Council Members of the City Of Lancaster, Texas
Pursuant to Section 43.141 of the Texas Local Government Code, the undersigned petitioners (“Petitioners”) file this petition for disannexation, and in support show the following:
1. Petitioner A is the sole property owner of a 63.644-acre parcel of land in Dallas County, Texas, the entirety of which is located in the City of Lancaster, Dallas County, Texas (the “Petitioner A Property”).
2. Petitioner B is the sole property owner of a 21.360-acre parcel of land in Dallas County, Texas, the entirety of which is located in the City of Lancaster, Dallas County, Texas (the “Petitioner B Property” and together with Petitioner A Property, the “Annexed Property”).
3. By Ordinance No. 2011-11-36 dated November 14, 2011, the City of Lancaster annexed land that included the Annexed Property.
4. Pursuant to this annexation, the City of Lancaster adopted an Annexation Service Plan under Section 43.056 of the Texas Local Government Code, describing planned services for the property annexed (the “Service Plan”).
5. The City of Lancaster has failed or refused to provide services or to cause services to be provided to the Annexed Property within the time periods specified by the Service Plan.
6. Pursuant to Section 43.141(a) of the Texas Local Government Code, as amended, Petitioner requests the disannexation of the Annexed Property, which constitutes a portion of the land annexed by Ordinance No. 2011-11-36, from the City of Lancaster.
7. The Annexed Property is a total of approximately 85.004 acres and is legally described on the survey and legal description attached as Exhibit A-1 and Exhibit A-2 and incorporated by reference. A map showing the location of the Annexed Property is attached as Exhibit B-1 and Exhibit B-2 and incorporated by reference.
THEREFORE, pursuant to Section 43.141 of the Texas Local Government Code, Petitioner requests that the City of Lancaster disannex the Annexed Property so that it is no longer part of the City of Lancaster.
