By virtue of a Final Judgment entered out of the 40th Judicial District Court of Ellis County, on December 12, 2019, in the case of Plaintiff Granite Pine Meadows, LLC, as Agent for Pine Meadows Estates Owners Association v. Defendants Unknown Heirs at Law of Danny C. Rozell, Deceased and Sandi F. Rozell, Cause No. 97284,  I have been commanded to conduct a public sale of the following property: Lot 33 at Pine Meadows Mobile Estates in Ellis County, TX (this is the name by which the land is most generally known) with a physical address of 3450 South Interstate Highway 35 East, Home Site 33, Waxahachie, TX 75165 as more particularly described as: 

BEING a 1/184 fractional undivided interest in and to all of Pine Meadows Mobile Estates, being a part of the J.C. Armstrong Survey, Abstract 6, Ellis County, n, and a part of a tract of land conveyed by Waxahachie Development Company to C.A. Wilson Company by Deed of record in Volume 535, Page 751, Deed Records, Ellis County, N, together with exclusive rights to use space No. 033 at Pine Meadows Mobile Estates, Waxahachie, TX 75165, subject to the provisions of the Rules and Regulation of the Pine Meadows Property Owners Association, as they may be amended from time to time, which provisions, and all amendments thereto, shall constitute covenants running with the land and shall bind any person having at any time any interest or estate in the before described property as though such provisions were recited and stipulated at length herein, and further subject to all zoning laws, regulations and ordinances of municipal and/or other governmental authorities, if any, but only to the extent that they are still in effect, relating to the hereinabove described property.

By virtue of a writ of execution issued by the Ellis County District Clerk, to me directed and delivered, I have levied upon this 30 day of March 2021, and I will conduct a public sate of the above described property on May 4, 2021 between the hours of 10 0’clock A.M. and 4 0’clock P.M. at the following location: the southeast porch of the Courthouse in Ellis County, Texas, or if the preceding area is no longer the area designated by the Ellis County Commissioners Court, at the area most recently designated by the Ellis County Commissioners Court.

The property described above shall be sold at public auction to the highest bidder. I shall execute and deliver a deed for the subject property to the person who was the successful bidder only after such person exhibits to me the items specified in Section Sec. 34.0445 of the Texas Civil Practice and Remedies Code. From the net proceeds of the public sale, I shall pay to Plaintiff the following: (1) the amount of $10,084.42 (for past due assessments) plus interest thereon at the Judgment rate of 5% from and after December 12, 2019 until paid; and (2) the amount of $7,000.00 (for reasonable attorney’s fees) plus interest thereon at the Judgment rate of 5% from and after December 12, 2019 until paid, in addition to costs of suit, including the costs of executing this writ.

Any surplus remaining after payment of the amounts referenced in this paragraph shall be paid by me to Defendants (if Defendants are not present on the date of the sale, I shall mail a check to Defendants at 129 Park Hills Dr. #2224, Waxahachie, Ellis County, Texas 75165.
