Thank you for the opportunity to respond to the questions sent to me on January 15 regarding my candidacy for Judge of the 40th District Court. I am excited to receive your request and will be distributing my answers to my campaign steering committee.
As you are aware, as a judicial candidate, the code of ethics prohibits me from commenting about matters which may come before my court. Keeping these matters in mind, as far as questions 1 and 2 are concerned, I will enforce the law in every case that comes before me to the best of my ability and provide to every litigant a level playing field consistent with the laws of the State of Texas. Any infraction of the law will, of course, be investigated by the proper law enforcement authorities.
As regard to question 3, I have appeared in the 40" District Court on many occasions and I am satisfied with the administrative aspects of the court. I am, however, giving consideration to the extension of the court hours in order to give litigants more flexible settings. The judge of the 378" court has implemented a 6 p.m. docket on Monday night which has been successful in the clearing of the docket.
As for question 4, I can assure you that the court will be operated within budget and the taxpayers will receive value for the funds expended in operation of the 40th District Court. As a member of the Waxahachie City Council and as Mayor Pro Tem and Mayor, the city council has been successful in keeping the tax rate for the citizens of Waxahachie stable. In fact, during the six years that I have been on the council, the tax rate for the city of Waxahachie has slightly declined. This was accomplished by the leadership of the Waxahachie City Council and the city staff working in close cooperation to achieve these results. I further pledge to be courteous to all litigants and their attorneys and provide a respectful and predictable environment for all those who come before my court. I further pledge to provide, consistent within the law, a level playing field for all those who come before me.
As fat as question 5 is concerned, I believe that I have the proper judicial temperament to provide consistent, fair, and predictable rulings and decisions for attorneys and parties who appear before me. Having actively practiced law for over 43 years, I feel that I possess the experience and knowledge to carry out fairly the duties as judge of this court. I have appeared in front of many judges over this period of time and the best judges are those who have fairly examined the issues before them and rendered a decision based not upon where the attorneys live and practice or the condition of the litigants but rendered decisions based upon the facts and the law.
