Candidates son in violation mix-up

WAXAHACHIE – James Kennedy is still in the Ellis County jail for failure to register as a sex offender, but a local prosecutor made a case for a possession of drug charge instead.
Kennedy, 23, is the son of Libertarian Party county treasurer candidate Cathy Kennedy, and visited probation authorities last week to file transfer papers to Wise County, where he’s set to move, but Ellis County officials apparently didn’t get the information and issued a warrant for his arrest.
Judge Gene Knize dismissed the violation of probation charge against Kennedy, who was accused of sexual assault when he was 12-years-old, but he’s still in jail for misdemeanor drug possession, his mom said.
James Jenkins, a Wax-ahachie defense attorney who is representing Ken-nedy, was set to file a writ of habeas corpus to compel prosecutors to show why Kennedy remains in jail despite the fact Kennedy was originally arrested for failure to register as a sex offender.
Kennedy said the Waxa-hachie Police Department’s registrar, Rodney Guthrie, who also serves as an Italy city councilman, said he wouldn’t have to report for a visit since Kennedy spoke with him shortly before his reporting date.
That event occurred several months ago, but Guthrie reportedly told prosecutors he didn’t remember telling Kennedy he didn’t have to report to him.
