NOTICE OF REGULAR MEETING ELLIS COUNTY COMMISSIONERS’ COURT

 

Notice is hereby given that a regular meeting of the Ellis County Commissioners’ Court will be held on Monday, May 12, 2008 at 10:00 A.M., in the Commissioners’ Courtroom, 101 West Main Street (2nd Floor), Waxahachie, Texas at which time the following will be discussed and considered, to-wit:

3.         ADMINISTRATIVE

 

3.1       Presentation from Paul Cauduro, Director of Government Relations for the Home Builders Association of Greater Dallas and Ellis Counties, about new building inspection regulations from the Texas Residential Construction Commission (TRCC).

3.2       Presentation of Continuing Education Certificates to Commissioner Dennis Robinson, Commissioner Bill Dodson and Commissioner Heath Sims for attending the 50th Annual County Judges’ and Commissioners’ Continuing Education Conference by the V.G. Young Institute of County Government.

3.3       Consideration and action authorizing payment in an amount of $544.37 to Jimmy Lee Harvey, Jr., for towing charges which were incurred as a result from an alleged wrongful arrest by an employee of the Ellis County Sheriff’s Department on or about May 1, 2008, in exchange for a full release of all claims against Ellis County related thereto.

3.4       Consideration and action to approve settlement in Cause No. 75,482, Ellis County, Texas v. Barbara Parsons and Stephen Parsons, Individually and d/b/a BMP Auto, in the 40th Judicial District Court of Ellis County, Texas.

3.5       Consideration and action to authorize the Ellis County and District Attorney to enter into non-binding arbitration with the City of Midlothian against Kehe Food Distributors, Inc., and its successors and assigns, to attempt to resolve legal action concerning Kehe’s breach of a tax abatement agreement entered into by all parties.

3.6       Consideration and action authorizing payment in an amount up to $350.00 to Ramiro Martinez for repairs to a residential dwelling owned by him which was allegedly damaged by an employee of the Ellis County Sheriff’s Department during the course of his employment on or about February 13, 2008, in exchange for a full release of all claims against Ellis County related thereto.

3.7       Consideration and action to approve the addendum to the Master Service Agreement called County and Government Service Automation, Inc. to add charges for existing users effective May 1, 2008.

3.8       Consideration and action to approve the Interlocal agreement between the city of Ovilla and Ellis County for road construction and maintenance of Johnson Lane and a portion of Duncanville Road.

3.                  DEPARTMENT OF COUNTY DEVELOPMENT

 

Consideration and action regarding the following presented by Delton Ake, Director Department of County Development:

 

4.1              Replat – Indian Head, Phase II, lots 9 & 10, Amy and Billy Hassell, Pct. 1

4.2              Final – Rockett Ranch, 21 lots, Jeff Love, Pct. 1

4.3              Presentation on environmental issues in Ellis County

 

5.         PURCHASING

Consideration and action regarding the following presented by Richard Denniston, Purchasing Agent:

 

5.1              Consideration and action as may be appropriate to declare one (1) lot of outdated law books as surplus for the DA’s Office and approve their disposal at auction or via sealed bids.

5.2              Consideration and action as may be appropriate to declare one (1) lot of outdated legal books from the Law Library as surplus and approve of their disposal using bids or online auction.

5.3              Consideration and action as may be appropriate to approve the renewal of the County Liability and Hazard Insurance with Trident Insurance Company using Hibbs-Hallmark as our representative.

 

                                   

6.         RECESS TO CONVENE TO EXECUTIVE SESSION

 

 

7.         EXECUTIVE SESSION       

“The Commissioners’ Court of Ellis County reserves the right to adjourn into Executive Session at any time during the course of this meeting to discuss any of the matters listed in this agenda, in the order deemed appropriate, as authorized by Texas Government Code §551.071, §551.072, §551.074 or to seek the advice of its attorney and/or other attorneys representing Ellis County on any matter in which the duty of the attorney to the Commissioners’ Court under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Texas Government Code Chapter 551 or as otherwise may be permitted under §551.071, §551.072, §551.074.”

 

7.1      Pursuant to Section 551.072 of the Government Code, consultation with counsel regarding the   possible sale or lease of real property   “if deliberation in an open meeting would have a detrimental effect on the position of the governmental body in negotiations with a third person.
