NOTICE OF REGULAR MEETING
ELLIS COUNTY COMMISSIONERS’ COURT
Notice is hereby given that a regular meeting of the Ellis County Commissioners’ Court will be held on Monday, April 28, 2008 at 6:00 P.M., in the Commissioners’ Courtroom, 101 West Main Street (2nd Floor), Waxahachie, Texas at which time the following will be discussed and considered, to-wit:

3.1 Consideration and action to approve a Proclamation for Moral Courage Week, May 4-10, 2008.

3.5 Consideration and action regarding selection of three (3) public members of Elected Official Salary Grievance Committee for FY 2005. (Names drawn from Grand Jury List obtained from County Clerk from District Clerk) (TX Local Government Code §152.014 and §152.015).
3.14 Consideration and action to issue payment to Wray and Willett, PLLC in the amount of $11,552.09, pursuant to invoice pertaining to legal services performed on behalf of the Ellis Prairie Soil and Water Conservation District in opposition to a petition seeking to create the Maypearl Water Control and Improvement District, in a matter pending before the Texas Commission for Environmental Quality and the State Office of Administrative Hearings.
3.6 Consideration and action to approve a proposal for professional services from Ellis Associates Surveyors for property surveying required for the acquisition of multiple real properties associated with the downtown bond construction program.

3.7 Consideration and action to approve a proposal for professional services from Ellis Associates Surveyors for property and construction surveying associated with the Ennis Sub Courthouse.

3.8 Consideration and action necessary to approve an evaluation criteria system by which the NRCS EWP sites can be ranked by Ellis County for bid purposes by the NRCS.

3.9 Consideration and action to accept the resignation of Mr. James Hightower from the Ellis County Rural Rail Transportation District Board and to appoint Mr. Joe Pitts to fill his position, effective immediately.
3.10 Consideration and action to approve contract with Jerry Frank Farr to provide mowing services for Pct. 3, effective April 28, 2008, through Dec. 31, 2008.
3.11 Consideration and action to approve an increase to the county mileage reimbursement from 48.5 cents per mile to 50.5 cents per mile in accordance with changes made by the Internal Revenue Service, effective April 29, 2008.
3.12 Discussion of road conditions relative to budget.
3.13 Consideration and action to set a date for a Commissioners’ Court Workshop for discussion of FY 2008-2009 Budget regarding division of Commissioners’ Court Members Budget.
4. DEPARTMENT OF COUNTY DEVELOPMENT
Consideration and action regarding the following presented by Delton Ake, Director Department of County Development:
4.1 To accept the construction of the infrastructure of Northeast Meadows, Phase II: Courtney Circle; Loycie Circle; Thames Circle; Winsor Circle; Bershire Lane Davenport Lane; and a portion of Chazlyn Court, Robbie Hale, Pct. 1.
4.2 To release the construction Letter of Credit #1145 to Inwood National Bank for the completed Northeast Meadows, Robbie. Hale, Pct 1.
4.3 Replat – Duvall Place Addition, lot 1 into eight lots with cul-de-sac, Duvall Court, Paul Proctor, Pct 4.
4.4 Preliminary Plat – Greathouse Circle Estates, 5 lots, Rodney Green, Pct. 3.
4.5 Final Plat – Rockett Ranch, 21 lots, Jeff Love, Pct. 1.
Consideration and action regarding the following presented by
5.1 To approve the payment of $74,579.82 to John Wright and Associates for seven (7) Arbitrator Camera Systems for patrol units. Purchase was made on a state contract with Panasonic and required no bids.
5.2 To approve the bid to Colwell Oil Company for the 12 month purchase of Convenience Store fuel. Contract will be for the period 5/1/2008 through 4/30/2009.
5.3 To approve equipment from Pct.4 as surplus and authorize sale at auction. Equipment is as follows:
One (1) 1993 Ford Â¾ Ton Pickup
One (1) 1995 International Dump Truck.
6. RECESS TO CONVENE TO EXECUTIVE SESSION
7. EXECUTIVE SESSION
“The Commissioners’ Court of Ellis County reserves the right to adjourn into Executive Session at any time during the course of this meeting to discuss any of the matters listed in this agenda, in the order deemed appropriate, as authorized by Texas Government Code §551.071, §551.072, §551.074 or to seek the advice of its attorney and/or other attorneys representing Ellis County on any matter in which the duty of the attorney to the Commissioners’ Court under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Texas Government Code Chapter 551 or as otherwise may be permitted under §551.071, §551.072, §551.074.”
7.1 Pursuant to Section 551.072 of the Government Code, consultation with counsel regarding the possible sale or lease of real property “if deliberation in an open meeting would have a detrimental effect on the position of the governmental body in negotiations with a third person.
7.2 Pursuant to Section 551.074 of the Government Code, to deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee.
