Notice is hereby given that a regular meeting of the Ellis County Commissioners’ Court will be held on Monday, 

January 10, 2011 at 10:00 a.m., in the Historic Ellis County Courthouse, Commissioners’ Courtroom (2nd flr), 101 W. Main Street, Waxahachie, Texas at which time the following will be discussed and considered, to-wit:

Consideration and action regarding the following presented by Delton Ake, Director Department of Development:


2.1       To grant a one-time variance from County of Ellis Rules, Regulations and Specifications for Subdivisions and Manufactured Homes as it relates to 150’ road frontage requirement per lot, Cross Creek Phase Seven, Section 2, lot 8R,  Mike Dillow, Pct. 4.


2.2       To grant a one-time variance from County of Ellis Rules, Regulations and Specifications for Subdivisions and Manufactured Homes as it relates to the requirement for a fire hydrant spaced every 450’ located in Whispering Meadows, lot 4B, on Wilson Road, Norma McAnally, Pct. 1.



      Consideration and action regarding the following presented by Richard Denniston, Purchasing Agent:


3.1       To approve the option to extend the following contracts for an additional 12 months for road materials and supplies: Wholesale Gas and Diesel, Recycled Concrete Flex Base, Lightweight Surfacing Aggregate, Unscreened Pit Run Gravel, Printing Services, Flexphalt. Pricing and terms remain the same as the 2010 agreements.                                                                                          




4.1       Consideration and action to increase the Electrolink contract for horizontal cabling from $375,000 to $394,500.  This increase is necessary to cover the cost of approved work associated with the Bond Project in Waxahachie and at the Sub-Courthouse at Ennis.

4.2       Consideration and action to add the generator at the new courthouse to the existing Historic Courthouse Preventative Maintenance Agreement with Emergency Power Services.  The cost is $3,000 annually.

4.3       Consideration and action to approve the retention of an attorney or attorneys to assist Ellis County during the redistricting process.

4.4       Consideration and action to approve the City of Ovilla’s request through an inter-local agreement that Pct. 4, repair, reseal, and maintain for three years:  E. University, Cardinal, Meadowlark and the 300 block of Willow Creek Lane; and put in two culverts on Red Oak Creek Road.

“The Commissioners’ Court of Ellis County reserves the right to adjourn into Executive Session at any time during the course of this meeting to discuss any of the matters listed in this agenda, in the order deemed appropriate, as authorized by Texas Government Code 551, or to seek the advice of its attorney and/or other attorneys representing Ellis County on any matter in which the duty of the attorney to the Commissioners’ Court under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Texas Government Code Chapter 551 or as otherwise may be permitted under 551.”


5.1       Pursuant to Section 551.072 of the Government Code, consultation with counsel regarding the                 possible sale or lease of real property   “if deliberation in an open meeting would have a detrimental             effect on the position of the governmental body in negotiations with a third person.”
