Consideration and action regarding the following presented by Delton Ake, Director Department of Development:
2.1 To grant a variance to County of Ellis Rules, Regulations, and Specifications for Subdivisions and Manufactured Homes as it relates to the fire hydrant to replat property, Hwy. 287, Reagor Gateway, Wayne Richerzhagen, Pct. 2.
2.2 To approve the location of 2585 South Highway 77, Waxahachie for a salvage yard, Luis F. Galo, Pct. 2.
2.3 To approve a Preliminary Plat for Hidden Hills Subdivision, 49 lots, North Texas District Council of Assemblies of God, Inc.; Pct. 3
PURCHASING
Consideration and action regarding the following presented by Richard Denniston, Purchasing Agent:
3.1 To award the bid for the construction of the Juvenile and Sheriff’s Facilities at the County Farm. The award recommendation is to Corbet Construction in the amount of $1,920,562 with a Contingency of $50,000. Total project cost not to exceed $1,970,562.
3.2 To award the bid for the excavation and paving at the County Farm Facilities to J & K Excavation. Cost of this project is $519,486.73 plus a contingency of $52,000 for a total project cost not to exceed $571,486.73.
3.3 To declare as surplus (1) 1999 Chevrolet (VIN 2GCEC19T4X1153804) and (1) 2002 Dodge Stratus (1B3EL36X5ZN118376).
ADMINISTRATIVE
4.1 Presentation by Casey Ballard of the benefits and methods to implement an Ellis County Employee Giving Campaign for the West Ellis County United Way’s 2011 Campaign.

4.2 Consideration and action for Terracon Consultants Inc. to provide professional engineering services for geotech and material testing associated with the County Farm development. Cost not to exceed 25,000.

4.3 Discussion regarding Section 502.185 of the Government Code, which allows Ellis County to enter into a contract with the Texas Department of Transportation to prohibit the registration of motor vehicles owned by individuals that owe the County money for a fine, fee, or tax that is past due.

4.4 Consideration and action to approve an agreement between Ellis County and TROTT Communications Group, Inc. for services of an independent engineering consultant to accomplish tasks related to the conversion from an existing wide band VHF, to a narrow band P25 Compatible radio system for a price up to, but not to exceed $49,000. TROTT is to specify the necessary equipment needed, assist the county in acquiring and reviewing bids, overseeing implementation and performance testing of the installed system, to be implemented and operational prior to January 1, 2013.

4.5 Consideration and action to accept the application of Don Weldon to replace Darryl McGee as a commissioner for ESD #7, effective immediately.

4.6 Consideration and approval regarding an Inter-local contract agreement with the City of Maypearl and Ellis County Road and Bridge, Pct. 3

4.7 Consideration and action to approve the First Supplemental Inter-local Agreement for Additional Funding for Fiscal Year 2010/2011 as per MINUTE ORDER NO 393.09 authorizing the County Judge to execute an interlocal agreement between Ellis, Johnson, Hill and Somervell Counties and the Prairielands Groundwater Conservation District wherein said counties agree to loan monies to the District for the maintenance and operation of the District on a short-term basis, said monies to be repaid by the District to the counties once the District has its own source and stream of revenue pursuant to the provisions of Texas Water Code, Chapter 36, and Senate Bill 726, Acts of the 81st Texas Legislature, Regular Session, 2009

4.8 Consideration and action in compliance with the rules of the Ellis County Bail Bond Board for the ratification and approval by the Commissioners’ Court of the appointment by the Ellis County Commissioners’ Court naming County Court at Law No. 2 Judge Gene Calvert to the slot statutorily designated for a judge of a county court or county court at law in the county having jurisdiction over criminal matters for the term of January through December, 2011.

RECESS TO CONVENE TO EXECUTIVE SESSION
EXECUTIVE SESSION
“The Commissioners’ Court of Ellis County reserves the right to adjourn into Executive Session at any time during the course of this meeting to discuss any of the matters listed in this agenda, in the order deemed appropriate, as authorized by Texas Government Code 551, or to seek the advice of its attorney and/or other attorneys representing Ellis County on any matter in which the duty of the attorney to the -Commissioners’ Court under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Texas Government Code Chapter 551 or as otherwise may be permitted under 551.”
5.1 Pursuant to Section 551.072 of the Government Code, consultation with counsel regarding the possible sale or lease of real property “if deliberation in an open meeting would have a detrimental effect on the position of the governmental body in negotiations with a third person.”
