Public Hearing

In accordance with Texas Local Government Code, and Wilmer City Ordinance No. 88-1206, the City of Wilmer City Council, Texas will conduct a second Public Hearing on Thursday, August 7, 2008 at 7:30 P.M. in the regular meeting place at 101 Davidson Plaza, Wilmer, Texas to consider an application for voluntary annexation and rezoning for a Planned Development District with base zoning of I-1 (Light Industrial) on property now zoned in the extraterritorial jurisdiction of the City of Wilmer located at the north side of Beltline Road, approximately 1/4 of a mile west of the railroad tracks, being approximately 95.7731 acres of land, as more particularly described as follows. BEING a 95.7731 acre tract of land situated in the A.K. Gray Survey, Abstract No. 505, and the W.W. Harvin Survey, Abstract No. 602, Dallas County, Texas and being all that tract of land described be deed to Gicarel Corporation as recorded in Volume 94142, Page 1173, Deed Records, Dallas County, Texas (D.R.D.C.T.), save and except all that tract of land described by deed to the County of Dallas as recorded in Volume 89177, Page 1960, D.R.D.C.T., and being more particularly described by metes and bounds as follows:

BEGINNING at a 1/2-inch iron rod with yellow cap marked "RPLS 3989" set for the Southeast corner of said Gicarel Corporation tract, said point also being in the North right of way line of Belt Line Road (a variable-width right of way) at the Northeast corner of said County of Dallas tract, and from said corner the centerline of the Union Pacific Railroad tracts bears North 70 degrees 08 minutes 02 seconds East, 462.0 feet;

THENCE South 60 degrees 08 minutes 02 seconds West, with said North right of way line and the North line of said County of Dallas tract, a distance of 429.51 feet to a 1/2-inch iron rod with yellow cap marked "RPLS 3989" set at the Northwest corner of said County of Dallas tract;

THENCE South 29 degrees 51 minutes 58 seconds East, continuing with said North right of way line and with the West line of said County of Dallas tract, a distance of 15.00 feet to a 1/2-inch iron rod with yellow cap marked "RPLS 3989" set at the Southwest corner of said County of Dallas tract;

THENCE continuing with the North right of way line of Belt Line Road (width varies), the following bearings and distances:

South 60 degrees 08 minutes 02 seconds West, 299.04 feet to a 1/2-inch iron rod with yellow cap marked "RPLS 3989" set at the beginning of a curve to the right;

With said curve to the right, having a radius of 522.96 feet, a central angle of 53 degrees 40 minutes 00 seconds, an arc length of 489.84 feet and whose long chord bears South 86 degrees 58 minutes 02 seconds West, 472.12 feet to a 1/2-inch iron rod with yellow cap marked "RPLS 3989" set;

North 85 degrees 35 minutes 58 seconds West, 202.68 feet to a 1/2-inch iron rod with yellow cap marked "RPLS 3989" set at the Southwest corner of said Gicarel Corporation tract and the Southeast corner of that tract of land awarded to Evelyn G. Roddy, et al, Probate #9100396-P2, Probate Records, Dallas County, Texas;

THENCE North 30 degrees 54 minutes 58 seconds West, departing said North right of way line with the common line of said Roddy, et al tract and said Gicarel Corporation tract, at 2155.85 feet, passing a 1/2-inch iron rod with yellow cap marked "RPLS 3989" set, a distance of 2340.72 feet, in all, to a point in the center of Cottonwood Branch, said point being the Northwest corner of said Gicarel Corporation tract;

THENCE with the centerline of Cottonwood Branch, the following bearings and distances;

North 67 degrees 14 minutes 50 seconds East, a distance of 250.56 feet;

North 33 degrees 53 minutes 31 seconds East, a distance of 147.14 feet;

North 86 degrees 01 minutes 06 seconds East, a distance of 86.18 feet;

North 72 degrees 31 minutes 54 seconds East, a distance of 72.49 feet;

South 84 degrees 31 minutes 49 seconds East, a distance of 99.74 feet;

North 43 degrees 16 minutes 49 seconds East, a distance of 74.26 feet;

North 16 degrees 01 minutes 00 seconds East, a distance of 29.45 feet;

North 61 degrees 22 minutes 58 seconds East, a distance of 126.05 feet;

North 72 degrees 49 minutes 18 seconds East, a distance of 46.20 feet;

South 84 degrees 05 minutes 53 seconds East, a distance of 58.66 feet;

North 76 degrees 51 minutes 47 seconds East, a distance of 57.14 feet;

North 31 degrees 15 minutes 33 seconds East, a distance of 45.77 feet;

North 26 degrees 57 minutes 12 seconds East, a distance of 112.80 feet;

North 57 degrees 19 minutes 57 seconds East, a distance of 192.00 feet;

North 18 degrees 09 minutes 57 seconds East, a distance of 90.00 feet;

South 76 degrees 39 minutes 00 seconds East, a distance of 74.48 feet;

South 86 degrees 11 minutes 41 seconds East, a distance of 141.41 feet;

North 61 degrees 57 minutes 15 seconds East, a distance of 121.31 feet;

North 46 degrees 38 minutes 56 seconds East, a distance of 155.00 feet;

North 20 degrees 37 minutes 13 seconds East, a distance of 87.46 feet to the Northwest corner of that tract of land described by deed with restrictions from the Wilmer Lion’s Club to the City of Wilmer and recorded in Volume 78001, Page 107, D.R.D.C.T., and also described in an affidavit by the Wilmer Lion’s Club and recorded in Volume 75061, Page 1301, D.R.D.C.T.;

THENCE South 22 degrees 03 minutes 58 seconds East, departing the centerline of Cottonwood Branch with the West line of said City of Wilmer tract and the East line of said Gicarel Corporation tract, at 229.96 feet, passing a 1/2-inch iron rod with yellow cap marked "RPLS 3989" set, a distance of 384.00 feet, in all, to a 1/2-inch iron rod with yellow cap marked "RPLS 3989" set at the Southwest corner of said City of Wilmer tract;

THENCE South 86 degrees 33 minutes 58 seconds East, continuing with said common line, a distance of 161.50 feet to a 1/2-inch iron rod with yellow cap marked "RPLS 3989" set at the Southeast corner of said City of Wilmer tract, said point also being in the West right of way line of Summer Street, an 80-foot right of way as shown in the Dallas County Plat Books, Volume 57, Page 380, Map Records, Dallas County, Texas (M.R.D.C.T.);

THENCE South 19 degrees 51 minutes 58 seconds East, with said West right of way line, a distance of 434.91 feet to 1/2-inch iron rod with yellow cap marked "RPLS 3989" set at the Northeast corner of Lot 4, Block B, H.A. Rumfelt’s Addition, an addition to the Town of Wilmer as recorded in Volume 1, Page 525, M.R.D.C.T.;

THENCE South 70 degrees 08 minutes 02 seconds West, departing said West right of way line with the common line of said Lot 4 and said Gicarel Corporation tract, a distance of 252.00 feet to a 1/2-inch iron rod with yellow cap marked "RPLS 3989" set at the Northwest corner of said Lot 4;

THENCE South 19 degrees 51 minutes 43 seconds East, with the West line of said H.A. Rumfelt’s Addition and the East line of said Gicarel Corporation tract, at 396.00 feet, passing the Northwest corner of Lot 5, Block A, said Rumfelt’s Addition, from which a 1-inch iron pipe bears North 70 degrees 08 minutes 02 seconds East, 1.08 feet, at 554.97 feet, passing a 1-inch iron pipe which bears North 70 degrees 08 minutes 17 seconds East, 0.37 feet from said common, at 705.50 feet, passing a 1-inch iron pipe found for the Northwest corner of Lot 1, Block A of said H.A. Rumfelt’s Addition, 1891.59 feet, in all, to the POINT OF BEGINNING and containing 95.7731 acres of land.
