PLANNING & ZONING COMMISSION and CITY COUNCIL

City of Wilmer, Texas

Z2013-04

 

In accordance with Chapter 211 of the Texas Local Government Code, the Planning & Zoning Commission and the City Council of the City of Wilmer, Texas will hold public hearings to consider a zoning request initiated by Southport Logistics XT, LP to establish a Planned Development (PD) zoning classification on an approximately 531.7-acre tract of land generally located in the extraterritorial jurisdiction of the City of Wilmer, Dallas County, Texas, adjacent to and southeast of Fulghum Road, north and northwest of E. Pleasant Run Road, and east of Interstate Highway 45, as more particularly described in the legal description below.  The subject property is currently being considered for annexation into the City of Wilmer at the property owner’s request and, if approved, the Planned Development (PD) zoning classification will take effect upon completion of annexation proceedings in accordance with the applicable procedures set forth in Chapters 43 and 211 of the Texas Local Government Code.

The first public hearing, and possible consideration/action, on this zoning request will be held before the Wilmer Planning & Zoning Commission on Thursday, November 14, 2013 at 7:00 p.m.

A second public hearing, and possible consideration/action, on this zoning request will be held before the Wilmer City Council on Thursday, December 5, 2013 at 7:00 p.m.

Both public hearings will be held in the regular meeting place, the City of Wilmer Community Center, located at 101 Davidson Plaza in Wilmer, Texas.

All persons interested in the proposed zoning request are invited to attend the public hearings and to provide their comments at that time.  Comments may also be submitted in writing (or via fax or email) to the City at least 24 hours prior to the beginning of each public hearing at the following address:

Legal Description of the Subject Property:

BEING a lot, tract or parcel of land located in the George W. Scott Survey, Abstract No. 1273 and the Robert Sloan Survey, Abstract No. 1271, Dallas County, Texas, and being all of a called 531.68 acre tract of land described in the Quit Claim Deed from PRR Properties, LLC, to Union Valley Ranch, L.P., filed for record under the County Clerk’s Instrument No. 201200238635, Official Public Records, Dallas County, Texas (O.P.R.D.C.T.), same being all of that certain called 531.706 acre tract of land described Tract I in the Special Warranty Deed to PRR Properties, LLP, filed for record under the County Clerk’s Instrument No. 20080200134, (O.P.R.D.C.T.), and being more particularly described by metes and bounds as follows:

All deed calls for bearings and distances are based on the abovementioned Quit Claim Deed.

BEGINNING at a railroad spike found (Controlling Monument) at the most westerly corner of said 531.68 acre tract, and being on the approximate centerline of Fulghum Road (a called 60’ public right-of-way by prescription, no recorded document found);

THENCE along the approximate centerline of Fulghum Road as follows:  North 55°09’15” East (North 53°21’34 East - Called), a distance of 1.25 feet, to a railroad spike found (Controlling Monument);

North 59°19’42” East (Basis of Bearings), a distance of 3029.13 feet (3029.06 feet - Called), to a railroad spike found (Controlling Monument);

North 59°24’06” East (North 59° 24’ 11” East - Called), a distance of 942.26 feet (942.20 feet - Called), to a railroad spike found (Controlling Monument);

North 59°38’21” East (North 59°38’26” East - Called), a distance of 835.83 feet (836.02 feet - Called), to a railroad spike found (Controlling Monument);

North 59°37’24” East (N59°37’26”E - Called), a distance of 1544.14 feet (1544.10 feet - Called), to a 1/2 inch iron rod found at the most northerly corner of the aforesaid 531.68 tract, said iron rod also being the most westerly corner of that certain tract of land described in the deed to Gilibardo Benitez, filed for record in Volume 99232, Page 3826, Deed Records, Dallas County, Texas (D.R.D.C.T.);

THENCE along the northeasterly line of said 531.68 acre tract as follows: South 33°31’27” East (South 33°30’49” East - Called), departing the approximate centerline of the aforesaid Fulghum Road, and along the southwesterly line of said Gilibaldo Benitez, a distance of 1329.42 feet (1328.95 feet - Called), to a 5/8 inch iron rod found with yellow cap stamped “Cotton Surveying”;

North 61°19’35” East, along the southerly line of said Benitez tract, a distance of 290.15 feet (290.61 feet - Called), to a 5/8 inch iron rod found at the northwest corner of that certain tract of land described in the deed to Sylvesta Adams, filed for record in Volume 2004047, Page 8576, (D.R.D.C.T.);

South 30°24’23” East (South 30°24’29” East - Called), departing the southeasterly line of said Benitez tract, and along the southwesterly line of said Sylvesta Adams tract, at a called distance of 226.98 feet, passing the southwest corner of said Adams tract, same being the northwest corner of that certain tract of land described in the deed to Paul Leighton and Elizabeth Leighton, filed for record in Volume 2004026, Page 9140, D.R.D.C.T., and continuing along the southwesterly line of said Leighton tract, in all a distance of 1492.57 feet (1492.63 feet - Called), to a 5/8 inch iron rod found (Controlling Monument), and being at the northwest corner of that certain tract of land described in Cause No. 04-0434-L, District Clerk’s Office, Dallas County Texas;

South 30°22’55” East (South 30°22’42” East - Called), along the westerly line of said tract described in Cause No. 04-0434-L, a distance of 2123.00 feet (2122.82 feet - Called), to a 5/8 inch iron rod found on the northwesterly right-of-way line of Pleasant Run Road (a called 70’ public right-of way);

THENCE South 59°42’17” West (South 59°40’41” West - Called), along said northwesterly right-of way line, a distance of 432.87 feet (432.63 feet - Called), to a 2 inch iron pipe found (Controlling Monument), at the most easterly corner of a called 39.4005 acre tract of land described in the deed to Run Pleasant Properties, Ltd., filed for record in Volume 2000140, Page 6316, D.R.D.C.T.;

THENCE North 28°12’02” West (North 28°12’39” West - Called), departing said northwesterly right of- way line and along the northeasterly line of said 39.4005 tract, a distance of 1044.35 feet (1044.73 feet - Called) to a 1 inch iron rod found (Controlling Monument), at the most northerly corner of said 39.4005 acre tract;

THENCE South 59°29’41” West (South 59°29’32” West - Called), along the northwesterly line of said 39.4005 acre tract, at a called distance of 1617.50 feet passing the most westerly corner of said 39.4005 acre tract and the most northerly corner of a called 52.417 acre tract of land described in the deed to said Run Pleasant Properties, Ltd., filed for record in Volume 2000140, Page 6320, D.R.D.C.T., and continuing along the northwesterly line of said 52.417 acre tract, in all a distance of 3517.97 feet (3517.87 feet - Called), to a 1/2 inch iron rod found (Controlling Monument) at the most easterly corner of a called 109.76 acre tract of land described in the deed to Wilmer Pleasant Run, LP, filed for record under County Clerk’s Instrument No. 20070131503, O.P.R.D.C.T.;

THENCE North 28°54’31” West (North 28°52’54” West - Called), departing the northwesterly line of said 52.417 acre tract, and along the northeasterly line of a called 109.76 acre tract, a distance of 1086.38 feet (1086.51 feet - Called), to a wood fence post found (Controlling Monument) at the most easterly northeast corner of said 109.76 acre tract;

THENCE South 59°33’45” West, along the northwesterly line of said 109.76 acre tract, a distance of 2819.37 feet (2820.16 feet - Called) to a point for corner at the southeast corner of a called 99.5785 acre tract of land described in the deed to Salbar, Inc., filed for record under the County Clerk’s Instrument No. 20070282842, O.P.R.D.C.T., from which a 4 iron inch pipe found bears North 61°27’59” East, a distance of 30.64 feet;

THENCE North 30°39’30” West, along the northeasterly line of said Salbar, Inc. tract, a distance of 2813.18 feet (2812.84 feet - Called), to the POINT OF BEGINNING and containing 531.7 acres (23,161,972 square feet) of land, more or less.
