NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

On or about July 12, 2013, the Texas Department of Housing and Community Affairs (TDHCA) will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of HOME Investment Partnerships Program funds under Title II of the Cranston Gonzalez National Affordable Housing Act of 1990, as amended, to undertake a project known as Home Reservation System on scattered sites within Ellis County, Texas. WREM Literacy Group Inc. will utilize funds under HOME Reservation number 2012-0080 which includes but is not limited to the following contract numbers: 1001905, 1001906, 1001908 and 1001909, to provide reconstruction, rehabilitation and down payment assistance to single family homes located within Ellis County, Texas. A portion of these funds has been set aside to assist people with disabilities. WREM is proposing to assist from 1 to 50 homes if funding becomes available. The maximum amount available per home for each activity is as follows: A maximum of $85,000 for Reconstruction, a maximum of $40,000 for Rehabilitation and a maximum of $20,000 for Down Payment Assistance and Closing Costs. A tiering plan was created for this proposed project and as homes are identified a site specific review will be conducted for each home and submitted to TDHCA for review.
The activities proposed are Categorically Excluded under HUD regulations at 24 CFR 58.35(a) from National Environmental Policy Act requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at 221 East 11th Street, Austin, Texas 78711 and WREM Literacy Group Inc, 100 Clark Street, Prairie View, Texas 77446 and may be examined or copied weekdays 9:00 A.M. to 4:00 P.M.
Any individual, group, or agency may submit written comments on the ERR to the TDHCA. All comments received by July 11, 2013 will be considered by TDHCA prior to authorizing submission of a request for release of funds.
RELEASE OF FUNDS
The TDHCA certifies to HUD that Brenda Hull in her capacity as Director of Program Service’s consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the WREM Literacy Group Inc. to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will consider objections to its release of funds and the TDHCA certification received by July 29, 2013 or for a period of fifteen days following its actual receipt of the request
(whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the TDHCA; (b) the TDHCA has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to HUD Fort Worth Regional Office at 801 Cherry Street, Unit #45 – Suite 2500, Fort Worth, Texas 76102. Potential objectors should contact HUD to verify the actual last day of the objection period.
