Public Hearing

In accordance with Texas Tax Code, Chapter 312 et. Seq. the City Council of the City of Wilmer will conduct a Public Hearing on Thursday, November 15, 2012 at 7:30 p.m., in the regular meeting place at 101 Davidson Plaza, to consider: an Ordinance of the City of Wilmer, designating Wilmer Reinvestment Zone 2; providing eligibility of the zone for commercial-industrial tax abatement; containing findings that the area qualifies to be designated as a tax abatement reinvestment zone and the improvements sought are feasible and practicable, the property located at:

LEGAL DESCRIPTION – 722534B

DESCRIPTION, of a 0.0826 acre tract of land situated in the Robert Sloan Survey, Abstract No. 1271, Dallas County, Texas; said tract being all of that tract of land described in Deed and Bill of Sale with Limited Warranty to AT&T Communications of Texas, Ltd. recorded in Volume 2000095, Page 1275 of the Deed Records of Dallas County, Texas; said 0.0826 acre tract being more particularly described as follows:

COMMENCING, at a 1/2-inch iron rod with “Halff Assoc Inc” cap found; said point being the south corner of Lot 1, Block D, Sundridge Business Park, an addition to the City of Wilmer, Texas according to the plat recorded in Instrument No. 20080137501 of the Official Public Records of Dallas County, Texas and in the northwest right-of-way line of Pleasant Run Road (a variable width right-of-way);

THENCE, North 65 degrees, 04 minutes, 00 seconds East, along the said northwest line of Pleasant Run Road, a distance of 89.17 feet to a 1/2-inch iron rod with “Halff Assoc Inc” cap found for the POINT OF BEGINNING;

THENCE, North 30 degrees, 44 minutes, 46 seconds West, departing the said northwest line of Pleasant Run Road, a distance of 57.75 feet to a 1/2-inch iron rod with “Halff Assoc Inc” cap found for corner;

THENCE, North 59 degrees, 25 minutes, 14 seconds East, a distance of 60.00 feet to a 1/2-inch iron rod with “Halff Assoc Inc” cap found for corner;

THENCE, South 30 degrees, 44 minutes, 46 seconds East, at a distance of 59.05 feet passing a 1/2-inch iron rod with “Halff Assoc In” cap found, said point being in the said northwest line of Pleasant Run Road, then continuing along the said northwest line of Pleasant Run Road in all a total distance of 60.00 feet to a point for corner;

THENCE, along the said northwest line of Pleasant Run Road, the following two (2) calls:

South 59 degrees, 25 minutes, 14 seconds West, a distance of 60.00 feet to a point for corner;

North 30 degrees, 44 minutes, 46 seconds West, a distance of 2.25 feet to the POINT OF BEGINNING;

Containing, 3,600 square feet or 0.0826 acres of land, more or less.

A tract of land situated in the Robert Sloan Survey, Abstract No. 1271, Dallas County, Texas, and being part of a called 101.578 acre tract of land described in deed to Wilmer Pleasant Run, L.P., as recorded in Volume 2005167, Page 4042 and Volume 2005167, Page 4050, Deed Records, Dallas County, Texas, and being more particularly described as follows:

Commencing at a point in the Northwest line of Pleasant Run Road, as defined by right-of-way Deed to Dallas County as recorded in Volume 3289, Page 192, Deed Records, Dallas County, Texas, at the Southwest comer of said 101.578 acre tract and the most Easterly comer of a called 37.852 acre tract of  land  described  in  deed  to Wilmer  Fulgrum  161,  L.P.  as recorded  under  Clerk’s File  No.

20070282844, Deed Records, Dallas County, Texas;

North 59 degrees 18 minutes 55 seconds East, along the Northwest right-of-way line, a distance of

390.02 feet to a point for comer;

THENCE North 65 degrees 04 minutes 09 seconds East, continuing along said Northwest right-of­ way line, a distance of 39.26 feet to a ½ inch iron rod with a yellow plastic cap stamped “Half Assoc., Inc.” (hereinafter referred to as “with cap”) set for the Point of Beginning on the herein described tract;

THENCE North 30 degrees 34 minutes 01 second West, departing said Northwest right-of-way line, a distance of 428.75 feet to a ½ inch iron rod with cap set for corner;

THENCE North 14 degrees 25 minutes 59 seconds East, a distance of 873.95 feet to a ½ inch iron rod with cap for comer, said point being on the North line of said called 101.578 acre tract and the South  line of a tract of land described  in deed to Wilmer  Pleasant Run, L.P. as recorded under Clerk’s File No. 20070131503,  Deed Records, Dallas County, Texas;

THENCE North 59 degrees 20 minutes 49 seconds East, along said North and South lines, a distance of 1,763.02 feet to a ½ inch iron rod with cap set for corner;

THENCE South 68 degrees 44 minutes 53 seconds East, departing said North and South lines, a distance of 597.59 feet to a ½ inch iron rod with cap set for comer;

THENCE South 30 degrees 51 minutes 38 seconds East, a distance of 576.34 feet to a ½  inch iron

rod with cap set on said Northwesterly right-of-way line of said Pleasant Run Road as recorded under

Clerk’s File No. 20080060159, Deed Records, Dallas County, Texas;

THENCE South 59 degrees 08 minutes 22 seconds West, along said Northwest line, a distance of

2,604.64 feet to a ½ inch iron rod with cap found for corner  on the East line of a tract of land described in deed to American Telephone and Telegraph Company (A.T.&T.) as recorded in Volume

3360, Page 8, Deed Records, Dallas County, Texas;

THENCE North 30 degrees 44 minutes 37 seconds West, departing said right-of-way line along said

East line, a distance of 59.05 feet to a ½ inch iron rod found for comer;

THENCE South 59 degrees 25 minutes 23 seconds West, along the North line of said A.T.&T. tract, a distance of 60.00 feet to a ½ inch iron rod found for corner;

THENCE South 30 degrees 44 minutes 37 seconds East, along the West line of said A.T.&T. tract, a distance of 57.75 feet to a ½ inch iron rod with cap found for corner on said Northwest right-of-way line of Pleasant Run road as dedicated in Volume 3289, Page 192, Deed Records, Dallas County, Texas;

THENCE  South  65 degrees  04 minutes  09 seconds  West, departing said West line along said

Northwest  right-of-way  line, a distance  of 89.17 feet to the Point of Beginning  and containing

2,611,608 square feet, or 59.95 acres of land, more or less.
