PURCHASING CONSIDERATION AND ACTION REGARDING THE FOLLOWING PRESENTED BY RICHARD DENNISTON, PURCHASING AGENT: 5.1 To declare a 1999 Ford Taurus (VIN 1FAFP53U2XA190945) Mileage 91,913 as surplus and authorize disposal at auction. Vehicle is from the District Attorney's Office 5.2 To approve the purchase of three (3) 2010 Ford Fusion passenger vehicles for the District Attorney's Office at a cost of $16,431 each ($49,293 plus BuyBoard Fee $400= Total Order $49,693). The purchase will be through the BuyBoard with delivery being made through the Planet Ford Dealership. 5.3 To award the 2010 Annual Contract for Printing Services to Gingerbread Press (Culego) based on low bid. Contract contains two (2) one year renewal options. 5.4 To award the 2010 Annual contact for Lightweight Road Surfacing Material to TXI Co. based on low bid. Contract contains two (2) one year renewal options. 5.5 To award the 2010 Annual Contract for Recycled Concrete Flex base to Big City Crushed Concrete based on low bid. Contract contains two (2) one year renewal options. 5.6 To award the 2010 Annual Contract for 50:50 Recycled Concrete/Asphalt to Big City Crushed Concrete. Contract has two (2) one year renewal options. 5.7 To award the 2010 Annual Contract for Unscreened Pit Run Gravel to Trinity Materials based on low bid. Contract contains two (2) one year renewal options. 5.8 To award the 2010 Annual Contract for Bulk Fuel to Avenue Fuel based on a price quote of Rack Price (price paid at the refinery) plus 0.08 cents. Contract contains two (2) one year renewal options. 5.9 Discussion only of a proposed purchasing procedure for new and used vehicles as requested by Commissioner Sims. 6. EXECUTIVE SESSION "The Commissioners' Court of Ellis County reserves the right to adjourn into EXECUTIVE SESSION at any time during the course of this meeting to discuss any of the matters listed in this agenda, in the order deemed appropriate, as authorized by Texas Government Code §551.072, or to seek the advice of its attorney and/or other attorneys representing Ellis County on any matter in which the duty of the attorney to the -Commissioners' Court under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Texas Government Code Chapter 551 or as otherwise may be permitted under §551.072." 7.1 Pursuant to Section 551.072 of the Government Code, consultation with counsel regarding the possible sale or lease of real property "if deliberation in an open meeting would have a detrimental effect on the position of the governmental body in negotiations with a third person". 8.
