County files suit over vehicles

ELLIS COUNTY – All four commissioners authorized W. Lee Auvenshire, assistant Ellis County and District Attorney, to file a civil lawsuit against Holly Brooksher for damages resulting in a collision with a county owned vehicle in 2008.

The incident occured on Aug. 25, 2008 involving a 2002 Dodge Ram 1500 driven by Brooksher and a 2006 Chevrolet Impala owned by Ellis County and driven by deputy constable Tony Moore, pct.4.

Moore’s vehicle was stopped at a traffic light in Midlothian at the time it was struck by Brooksher, who had exited from a parking space in reverse.

"Ellis County has attempted unsuccessfully to resolve this matter with the insurer for Ms. Brooksher’s vehicle," said Auvenshire.

The county is filing suit solely to recover the amount it incurred in property damages.
